Terms & Conditions

These Terms & Conditions (“Terms”) govern use of www.labaker.com and purchases of LA Baker Inc. products and services.

By creating an account, placing an order subject to these Terms, or affirmatively accepting them, you agree to the applicable provisions.

Wholesale purchases are additionally governed by our Wholesale Terms & Conditions and any separately executed agreement.

LA Baker offers breads, pastries, cakes, desserts, customized bakery products, and related items.

Product availability, presentation, packaging, specifications, and prices may change.

We make reasonable efforts to provide accurate descriptions and images. Actual appearance may vary due to handcrafted production, ingredient availability, and reasonable presentation differences.

Material substitutions affecting allergens, agreed specifications, or dietary representations will be handled according to applicable law and the accepted order.

Submitting an order constitutes an offer to purchase.

An order becomes accepted when LA Baker confirms acceptance or begins fulfillment, whichever occurs first.

Orders remain subject to payment authorization, product availability, production capacity, and delivery feasibility.

We may decline or cancel orders for legitimate reasons, including suspected fraud, incorrect pricing, unavailable products, or inability to fulfill the order.

If LA Baker cancels an accepted prepaid order, the amount paid for the unfulfilled portion will be refunded as legally required.

Prices are stated in U.S. dollars unless otherwise indicated.

Applicable taxes, delivery charges, and other disclosed fees may be added.

Payment is required according to the terms presented at checkout or in an accepted quotation.

Customers must provide accurate and authorized payment information.

Retail customers may request cancellation before production begins.

Once production has started, cancellation may be declined, subject to applicable law and any cancellation restrictions disclosed before purchase.

An unfulfilled order canceled before production begins is eligible for a refund of amounts paid, except for any separately agreed and legally permissible nonrefundable charges.

The cancellation request must be received and acknowledged before production begins. Submitting a request does not automatically stop production.

Customized cakes, personalized desserts, and special-production items may require deposits, advance payment, or written specifications.

Cancellation requests must be submitted at least 48 hours before scheduled fulfillment.

A timely request does not automatically guarantee a full refund if production has already begun or lawful, previously disclosed customization costs have been incurred.

Requests received less than 48 hours before fulfillment may be declined or subject to agreed cancellation charges.

Any deposit restrictions, customization fees, or nonrefundable charges must be disclosed and accepted before the order is finalized.

Customers are responsible for reviewing and approving names, inscriptions, designs, quantities, and other submitted customization details.

LA Baker handles ingredients that may include wheat, milk, eggs, soy, peanuts, tree nuts, sesame, and other allergens.

Customers with allergies or dietary restrictions should review product-specific information and contact LA Baker before ordering.

A halal designation does not mean that a product is free from allergens or other dietary ingredients.

LA Baker remains responsible for complying with applicable food safety and labeling requirements.

Orders are subject to our Shipping & Delivery Policy.

Delivery windows are estimates unless expressly guaranteed in writing.

Customers must provide accurate addresses, contact information, and appropriate receiving arrangements.

Returns, refunds, and cancellations are governed by our Returns, Refunds & Cancellations Policy.

Refunds are ordinarily issued to the original payment method or as store credit where mutually agreed and legally permitted.

Store credit will not replace a monetary refund where a monetary refund is legally required.

Customers must provide accurate information and safeguard their account credentials.

LA Baker may suspend accounts for legitimate security, fraud-prevention, or material contractual reasons.

The LA Baker name, branding, website content, product photographs, and proprietary materials are owned by LA Baker or used under appropriate authorization.

Unauthorized commercial reproduction or exploitation is prohibited, except as permitted by law.

Users may not engage in fraudulent transactions, unauthorized system access, interference with website operations, or other unlawful activities.

To the maximum extent permitted by applicable law, LA Baker does not guarantee uninterrupted or error-free website operation.

LA Baker shall not be liable for indirect or consequential damages arising from website use or transactions where such exclusions are legally enforceable.

Nothing in these Terms excludes or limits liability for fraud, personal injury, unsafe food, gross negligence, willful misconduct, or other liability that cannot lawfully be excluded.

These Terms are governed by New York law, subject to applicable mandatory consumer protection laws.

Disputes shall be brought before courts of competent jurisdiction, unless a valid separate agreement provides otherwise.

The Privacy Policy governs personal information practices.

The Shipping & Delivery Policy governs delivery procedures.

The Returns, Refunds & Cancellations Policy governs ordinary retail returns and cancellation eligibility.

Wholesale transactions are governed by the Wholesale Terms & Conditions, with any separately executed commercial agreement controlling to the extent of an express conflict.

Nothing in this section overrides non-waivable legal rights.

Revised Terms apply prospectively unless the parties lawfully agree otherwise.

The version applicable when an order is accepted generally governs that order.
